Terms of Service — Loquenza

In short. These terms cover who can use Loquenza, how subscriptions and billing work, what you may and may not do, and who owns what. Please read them — by using Loquenza you agree to them and to our Privacy Policy.

1. Agreement to these terms

These Terms of Service are a binding agreement between you and [Operating Entity] (“Loquenza”, “we”, “us”), and govern your use of the Loquenza app and website. By creating an account or using Loquenza, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Loquenza.

2. Eligibility

You must be at least 18 years old to use Loquenza, and you confirm this when you sign up. The app is rated 17+. If you do not meet the age requirement, you may not use the service.

3. Your account

Provide accurate information and keep your password secure. You are responsible for activity that happens under your account. Tell us at support@loquenza.com if you suspect unauthorised use.

4. Your licence to use Loquenza

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Loquenza for your own language learning, subject to these Terms. You may not copy, resell, reverse-engineer, scrape, or otherwise misuse the service or attempt to access it in unauthorised ways.

5. Subscriptions, billing, and renewals

Loquenza offers a free tier (with limits, such as a daily lesson and a capped phrase library) and a paid Premium subscription (currently US$11.99 per month; prices may vary by region and change over time). A free trial — typically 7 days — may be offered.
Purchases and renewals are processed by the app store you buy through — the Apple App Store or Google Play — and managed through our billing partner, RevenueCat. We do not receive your payment-card details.
Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours beforehand. Your store account is charged for each renewal.
Managing or cancelling. You can manage or cancel your subscription at any time in your Apple or Google account settings. If you cancel, Premium remains active until the end of the current paid period, after which your account moves to the free tier.
After a downgrade. Your saved phrases are preserved, but access may be capped to your most recently used phrases until you upgrade again.
Refunds. We stand behind a 14-day refund — just email support@loquenza.com. Because purchases are processed by the app stores, refunds are ultimately subject to their policies, but we will help you obtain one.

6. Acceptable use

Use Loquenza lawfully. Do not record or submit content that is illegal, harmful, harassing, or that infringes others’ rights; do not attempt to disrupt the service or gain unauthorised access; and do not use Loquenza to harm minors. We run automated content-safety checks on generated content and may review flagged material. We may remove content or suspend accounts that breach these Terms.

7. Your content and recordings

You keep ownership of the content you create, including your voice recordings and saved phrases. You grant us a limited, worldwide licence to host, process, and analyse that content solely to operate and provide the service to you — for example, to transcribe and score your speech. We do not sell your content, and we do not use your recordings to train third-party AI models. See the Privacy Policy for how recordings are stored and deleted.

8. Our intellectual property

Loquenza — including the app, website, design, and the AI-generated lesson material we provide to you — is owned by us or our licensors and protected by law. Your licence to use generated lesson content is for your personal learning. Our names, logos, and brand remain ours.

9. AI-generated content

Lessons, audio, definitions, and pronunciation feedback are generated automatically using AI and may contain errors or inaccuracies. They are provided for educational purposes only and are not professional, medical, certification, or other expert advice. Please use your own judgement.

10. Accessibility

Loquenza’s core experience is audio-based: it requires listening and speaking aloud. It may not work for people who are deaf or hard of hearing, and our scoring may misread atypical speech. We are committed to improving accessibility. If Loquenza is not right for you, our refund path in Section 5 applies.

11. Disclaimers

To the fullest extent permitted by law, Loquenza is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, or that feedback will be accurate or fit for any particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, [Operating Entity] and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of Loquenza. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

13. Indemnification

You agree to indemnify and hold harmless [Operating Entity] from any claims arising out of your misuse of the service or your breach of these Terms or applicable law.

14. Suspension and termination

You may stop using Loquenza and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the service or other users. On termination, your right to use Loquenza ends; we handle your data as described in the Privacy Policy.

15. Changes

We may update the service and these Terms. If we make material changes, we will update the effective date above and, where appropriate, notify you. Continuing to use Loquenza after a change means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of [Governing-law jurisdiction], without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there, except where mandatory local law gives you other rights.
